Appears to be a problem in the coding of the Youngstown World War II map
I'm currently playing Italy in a Youngstown World War II map, and I've run into a problem. The supply zone of Tirane is very obviously drawn so that it's adjacent to the Ionian Sea, but the game will not let me order a movement from the Ionian into Tirane.

I've got exams this week so could a kind soul please, please sit for me until Saturday. I'm only in two games so it shouldn't be too much of a burden. I'm trying to get an extend for the WWIV team game I am in, though, so I'm not sure if I need sitting for that yet.

World War IV map – spot between PAR and BEL?
does anybody know what the place in between PARis and BELgium is on the World War IV map?

Knowing each other/cooperating in an anonymous game
I am playing a game where the parties are meant to be anonymous and there have been moves that take careful coordination by two of the parties against me. Is there any way to look into this?

Take over from Civil Disorder thread
I wonder if the system can be put in condition to append an automatic message each time a country goes in Civil Disorder, displaying gameID, country, previous player (questionable).
That would shorten the distance between supply and demand and would help filling open positions in time…at least the playable ones.

Phantom Variant Idea

gameID=12532: Glitch Alert for Oli!
BIO can't move to SNT, VAL or MDZ, but can support all three. Also PIT can't convoy to VAL, ATA, or ARQ (I had a fleet in CHB for that purpose). I believe the game has a major glitch. Am I right, or was it the loaner computer I was using being dysfunctional (a distinct possibility)?

Major glitch in WWIV game.
I'm Oceania. BIO will not move to MDZ, SNT or VAL, yet it can support all three. Also, my army in PIT can not or will not convoy to ARQ, ATA or VAL. As Oceania all my best laid plans are now FUBAR.

I'm playing Haven, a really lovely variant, for getting your role-playing train of thought going. Haven's use of generic fantasy concepts such as "Trolls," "Knights," and "Wizards" is clearly not a problem. But can't an argument be made that this variant infringes copyrights in various other respects?

1. Haven uses "Hobbits" as a faction which is an original concept of J.R.R. Tolkien, and the variant also borrows several place names from the LotR trilogy. The Hobbit doesn't enter the public domain until 2035, and the LotR trilogy does not become public domain until several years after that.

2. The amount of place names which Haven rips off of Dragonlance is just astounding.

3. The visual depiction of the Elves' armies bears a more than passing resemblance to Link of "The Legend of Zelda" video games.

4. Probably other instances of copying which I haven't noticed.

5. However, these copyrighted materials are amalgamated with generic conepts and original ideas to such an extent that the Haven map as a whole does not invoke any pre-existing fiction world.

6. Additionally, this site doesn't charge a subscription, so maybe that would also help to avoid copyright claims as part of a "fair use" defense.

My question to whoever is responsible for adopting and approving variants for this site: Have you ever rejected a variant because you were afraid it might expose the site to copyright infringement claims? For instance, I know there's a full-fledged Middle Earth variant out there somewhere, but I've noticed that it hasn't been adopted. I've also noticed that the vast majority of variants on this site are either based on historical events (part of the public domain), or alternate histories, or made up fictional scenarios which would be the original intellectual property of the variant designer.

I'm particularly interested in this question because I would love to design a "World of Warcraft" variant for use on the site, but to do so would involve basing an entire map around a single online game (a quite lucrative one at that) and necessarily involve substantial copying of Blizzard's material to a much greater, and more precise, extent than Haven for example copies Dragonlance or LotR.

I'm several years from passing the bar so unfortunately I cannot offer a professional legal opinion on this question... or defend the site in case of legal trouble... although if I could I would happily represent VDip on a pro bono basis. :)

I refused quite some variants because of copyright issues.
I play better save than sorry. If you want to play a variant completely based on someone else's intellectual property you need to run it on your own servers and take the responsibility.

You could always contact the copyright holders and ask if it's okay to use it. I did so for my Morrowind variant (which has since been temporarily abandoned).

Unfortunately, something tells me the copyright holders of World of Warcraft would charge a pretty penny to license their stuff. Especially given the existence of an (also presumably lucrative) WoW board game. But, I bet there are less-known fictional worlds out there that some sci-fi/fantasy authors would let you adapt for free. And there's always the public domain. Homer's "Odyssey" variant anyone? hah..

@Amwidkle: To answer your question.
1. While the hobbit is still under copyright, hobbits is in the public domain. D&D, hundreds of fantasy novels and other peaces of fiction use hobbits or halflings in their works. Even if the hobbit is under copyright, see my response to point #6 for an explanation as to why its allowed.

2. Every single territory on the board is the name of a city or town in a fantasy book, kept with the theme. However since this is a generic fantasy map and bears no relevance to any of the fantasy books that were used, I don't think this is breaking any copyright laws.

3. One could also claim it looks like Legolas from LOTR, or elves from multiple other games/movies. Its a generic depiction of a stereotypical elf from folklore, Link and many others fit that description.

6. You have stated the number one flaw of the rest of your work. The Haven map falls under the fair use clause of copyright, so its not a violation of copyright law. Parodies and critiques of a work fall under fair use so Haven would be fine. However just because something is nonprofit doesn't mean its can use fair use.

If I am handing out copies of a song you produced for free, I am violating copyright, and just because I'm not for profit, doesn't mean I have fair use to give out free songs, since I am hurting the artist because he will no long make those sales.

So for example: Haven would fall under fair use, as its more of a parody of generic fantasy, but a map such as the proposed westeros map would not fall under fair use, as its taking events of a copy righted material and adapting it to a different media (in this case diplomacy variant). That would be a violation of copyright law, unless we get the permission of GRR Martin or HBO to do it, we would not be allowed to use a westeros map.

Hmm.... maybe it'd be fun to base a game on Richard Jeffries' 1880s children's story "Wood Magic", with the child and the creatures of the wood struggling against the tyranny of the Magpie King, but knowing it's going to be futile because the Pigeons of the Koo Khan's hordes will soon be coming in overwhelming numbers.

Thanks for the thoughtful response. I'm aware that free distribution of songs is copyright infringement, but this hypo is a bit different and could still fall under fair use even if not a parody or critique. I discussed the fact that this website doesn't charge a fee because "effect on the market" is one of the components (if not the most important component) of the fair use defense to copyright infringement (fair use is a four factor balancing test, see Harper & Row, Publishers, Inc. v. Nation Enterprises, 471 U.S. 539 (1985)). For instance, if we assume that the market of online Diplomacy variant players consists entirely of people who play for free, then you could make an argument that Blizzard (or whoever the copyright holder happens to be) isn't financially harmed by this kind of copyright infringement because "Diplomacy variants" is not a market that Blizzard could enter, develop and have an expectation of making a profit. However, the counterarguments would be: 1. Blizzard's financial interest in "Diplomacy variants' could still be expressed through licensing their ideas, artwork, etc., to variant creators, or 2. A free online Diplomacy variant based on WoW is essentially a substitute for World of Warcraft. Or, if not a perfect substitute, at least that the variant's online presence would have the effect of getting subscribers to play the variant instead of WoW. To me, the first counterargument seems more plausible, the second seems like more of a stretch, but the point is that proof of direct financial harm to the copyright holder is going to be harder if the derivative work isn't making money.

@Amwidkle: You could easily make the argument that they are hurt.

For example, Blizzard owning warcraft. If we made a warcraft variant we might hurt their sales because someone may not chose to buy warcraft because he could play a variation of warcraft for free.

Diplomacy variants of copyrighted material is a violation of copyright law, unless as captainmeme previously mentioned, you are able to get permission from the copyright holder.
I think that's a relatively small problem in the scope of things and I'm surprised you're worried about copyright infringement. Feel free to correct me if I'm wrong, but we don't have a license from Avalon Hill (or Hasbro or whoever bought the game) to run the site, do we?

I was wondering about that too. This whole site is a derivative of the original Diplomacy. Anyone know if such a license is owned/needed?

@fasces349: That's an interesting question. The thing is though, a Diplomacy variant of WoW would be a very poor substitute for the original game. It has none of the gameplay mechanics of an MMORPG, or even the original RTS like game like Warcraft III -- not even close. I'm not sure anyone would actually stop playing their video games because of such a variant. If anything it would probably get Blizzard more customers. Regardless though, I think they would still have a copyright claim on the use of Blizzard artwork, or even if the art is not used, the use of factions, maps, and place names from Warcraft lore (just as if WoW were a book or movie not a video game).

not stop playing, blizzard doesn't care if you play warcraft or not, they care whether or not you buy it, and having a crappy substitute may reduce the likelihood of them wanting to buy it.

@Amw: That's really a problem.
It pure luck that Dipomacy is a really small, old, geeky board-game, of a small subdivision of WotC. At the moment they just don't care. The moment they decide releasing their own digital version of the game most unofficial sites will need to close down.

On the other site if you take a well known IP there might be many more lawyers trying to earn money based on the IP (eg. they search the web for WoW and send you a big paycheck to avoid problems). And the bigger the IP, the more likely you will run into trouble.
This site is just a small hobby and I like to avoid any problems as much as possible.
A sorry does not help with the 6-digit+ sums they usually try to get.

If you are sure there won't be any problems just register your own domain, setup the webdip-code (it's really easy) and run your variant. Maybe make a server deliberately for variants with copyright issues many people will join your server for these variants. But I won't run these variants here.
I actually agree with Amwidkle on the point that the Warcraft variant will have minimal effects on Blizzard's financial prospects. From an objective point of view, a reasonable ordinary person is very likely to regard the variant as being substantially different from the MMORPG itself, therefore I think it will be a bit too remote to relate the emergence of this variant to the negative financial impact of Blizzard. It's a matter of reasonable foreseeability I would say.

@LP: It's just a matter of risk vs. reward...
If you think it's worth the risk setup the variant on your own server with all responsibility put on your shoulders.
@Oli: I am absolutely fine with you rejecting those potentially copyrght-infringing variants. My comment up there is not meant to argue against any previous propositions, nor is it any kind of prompt on you; it's just some more food for thought.
